RESOLUTION – DISMISSAL OF DITCH
IN THE MATTER OF THE
SINGLE COUNTY SCS DITCH #545
PETITIONED BY ROBERT RIEPENHOFF
The Board of County Commissioners of Putnam County, Ohio, met in regular session on the 16th day of November, 2010, in the office of the Board of County Commissioners with the following members present: Mr. John E. Love, Mr. Vincent T. Schroeder and Mr. Travis A. Jerwers.
Mr. Jerwers moved the adoption of the following Resolution:
WHEREAS, The objection hearing for the Robert Riepenhoff Ditch #545 was held this date in the Board of County Commissioners office. Present were Jeff Giesige, district technician for the Soil & Water office, Harold Kleman and Glen Koenig;
WHEREAS, During the hearing, the two landowners, Harold Kleman and Glen Koenig, voiced their objections concerning the cost and the proposed improvement to the ditch. These two landowners would incur approximately 65% of the cost of the improvement.
WHEREAS, Another letter of objection was received from landowner William D. Hanefeld, Sr.
WHEREAS, The landowners present felt they could improve the ditch privately and stated they do not want the ditch on the maintenance program.
now therefore, be it
RESOLVED, The Board of County Commissioners does hereby dismiss said ditch petition.
and be it further
RESOLVED, That all costs of the proceedings in said matter be and the same are hereby ordered to be paid by the persons who signed the bond namely, Robert Riepenhoff.
and be it further
RESOLVED, It is found and determined that all formal actions of this Board concerning and relating to the adoption of the Resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and of any of its Committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
Mr. Schroeder seconded the motion and the roll being called upon its adoption, the vote resulted as follows: Mr. Jerwers yes Mr. Schroeder yes Mr. Love yes
